Job Description

Terms of Reference (ToR) for

Policy review on Land lease, access to public and private land focusing on commercial agriculture with special focus on coffee plantation

Objective of the assignment:

The overall objective of this assignment is to review the existing policy and law related to land-lease, access to community forest, absentee land & other several land-types of communal belongings for commercial farming in general, coffee plantation in particular.

To support the development of coffee sector in Nepal, ‘Hamro Coffee: Expanding Opportunities for Nepalese Coffee Growers and Traders’ project jointly envisioned by ICCO Cooperation, together with partners CEAPRED and NCPA, aims to increase income of small-holders through an improved market driven speciality coffee sector, with focus on enhancing the quality and quantity of coffee cherries produced and upgrading primary processing to ensure quality of green beans, leading in the long term to increased demand of unique Nepalese speciality coffee in the domestic and international niche markets.

In Nepal, wee work towards eradicating extreme poverty and social exclusion via integrated programs on food and nutrition security, economic empowerment, responsible business, disaster risk reduction and Water, Sanitation and Hygiene.

Scope of the assignment: :

  • Review of the existing policies, laws  and institutional arrangements related to the lease of public and private owned land for coffee production

  • Assessment of the challenges and potentials for accessing the public and private land for coffee plantation at a commercial scale

  • Explore various legal instruments inclined towards potential use (lease-rent) of such lands for agriculture purpose (esp.coffee)

  • Review & suggest the useful legal provisions and practices in land-lease for commercial agriculture 

Methodology:

The interested consultants/firms are expected to undertake a desk review of current law/policies especially on lease of public and private land focusing on commercial agriculture with special focus on coffee plantation. In addition, the consultants/firms is also expected to have a close consultation with key stakeholders in government, civil society and private sector focusing on the bottlenecks that might hinder the effort to access the lease lands.

Expected outputs/deliverable:

The consultant is expected to submit the following deliverable:

  • Presentation of preliminary findings before drafting the report;

  • First draft of the review report excluding relevant annexes

  • Final detailed report of the review including relevant annexes required to produce a review report

Duration of the consultancy service

The consultancy agreement between the consortium and the consultant/firm will be from 1st of March to 31st of March 2019. The maximum working days would be 15 days within the consultancy duration. The tentative time plan for this assignment are as follows:

  • Procurement, negotiations and contract with consultant services by 1st March 2019.

  • Detailed orientation to consultant/firm by 5th March 2019.

  • Preliminary findings presentation, meeting and feedback by 20th March 2019

  • First draft submission with recommendation by 25th March 2019.

  • Final assessment report incorporating all inputs and comments from the consortium by 31st March 2019.

  • ICCO led consortium reserves the right to ask or obtain further details and documents from shortlisted consultants/firms during the course of proposal evaluation and negotiation process.

  • ICCO led consortium reserves all the rights to reject/dismiss this procurement process without assigning any reasons to applicants/potential consultants.

Other terms and conditions:

In case of occurrence of any unforeseen events leading to the deviation in the agreed upon deadlines and budget, this must be communicated to the focal person in advance and agreed upon the revised plan and budget.

  • A detailed proposed  methodologies and tentative action plan (3 page max) and financial proposal (1 page max) including per day rate and total consultancy fee in NPR including applicable VAT or consultancy taxes.

  • Enclose the latest version of relevant report (in PDF) of similar nature of consultancy assignment by the consultants/firm.
